IMPORTANT NOTICE

This Enrollment Agreement, Terms &Conditions, Assumption of Risk, and Release of Liability (“Agreement”) is a legally binding contract between the parent or legal guardian (“Parent”) and the American Youth Literacy Foundation, Inc., 501 c 3, doing business as FUNetix Reading Centers, USA (“FUNetix,” “Center,” “we,” “our,” or “us”).

By enrolling a student, scheduling an assessment, purchasing educational services, participating in instruction, using the FUNetix website, or electronically accepting this Agreement during checkout, you acknowledge that you have read, understood, and agree to be bound by all terms contained herein.

Parents are encouraged to review this Agreement carefully before enrolling their child. Questions regarding these Terms may be directed to the Center prior to enrollment.

Nothing in this Agreement limits any rights that cannot legally be waived under applicable law.

TABLE OF CONTENTS

1. ACCEPTANCE OF TERMS

This Agreement governs all educational services provided by FUNetix Reading Centers.

By any of the following actions, the Parent agrees to be legally bound by this Agreement:

  • enrolling a student;
  • purchasing instructional services;
  • participating in Center activities;
  • checking the electronic “I Agree” box during registration; or
  • allowing a student to participate in instructional services.

Electronic acceptance shall have the same legal force and effect as a handwritten signature to the fullest extent permitted under applicable federal and Pennsylvania law.

If you do not agree with these Terms, you should not enroll your child or use the Center’s services.

2. DEFINITIONS

For purposes of this Agreement:

“Center” refers to the FUNetix Reading Center location providing services.

“FUNetix” refers to the educational programs, curriculum, software, instructional materials, trademarks, digital applications, assessments, instructional methodologies, and services owned or licensed by the American Youth Literacy Foundation.

“Student” means the enrolled child receiving educational services.

“Parent” includes any parent, legal guardian, or individual legally authorized to enroll a student.

“Program” refers collectively to assessments, tutoring, reading instruction, educational software, digital curriculum, enrichment activities, workshops, evaluations, and related educational services.

“Staff” includes employees, tutors, instructors, volunteers, contractors, interns, administrators, directors, and authorized representatives.

“Session” means any scheduled instructional period, assessment, conference, or educational activity.

3. SERVICES

FUNetix Reading Centers provide educational services designed to improve literacy and reading proficiency through structured phonetic instruction and related educational support.

Services may include, but are not limited to:

  • literacy assessments;
  • reading evaluations;
  • individualized tutoring;
  • small-group instruction;
  • one-on-one instruction;
  • digital learning;
  • educational software;
  • parent conferences;
  • progress monitoring;
  • supplemental educational materials;
  • reading fluency activities;
  • educational games;
  • enrichment programs;
  • workshops;
  • seasonal camps; and
  • additional educational services offered by the Center.

The Center reserves the right to modify curriculum, lesson sequencing, instructional methodologies, staffing assignments, schedules, technology platforms, educational materials, pricing, and services whenever reasonably necessary to improve educational quality or operational efficiency.

Nothing contained in this Agreement shall be interpreted as guaranteeing that any specific instructor, tutor, lesson format, technology platform, or curriculum sequence will remain unchanged throughout a student’s enrollment.

4. EDUCATIONAL PHILOSOPHY

FUNetix Reading Centers exist to help children become stronger, more confident readers through evidence-informed instructional methods, structured phonetic instruction, engaging educational experiences, and positive encouragement.

Our educational philosophy emphasizes:

  • individualized instruction;
  • positive reinforcement;
  • measurable progress;
  • parent partnership;
  • consistent attendance;
  • student engagement;
  • mastery through repetition;
  • confidence building; and
  • lifelong literacy.

The Parent acknowledges that education is inherently individualized and that every student learns differently.

Educational success depends upon numerous factors beyond the Center’s control, including but not limited to:

  • age;
  • developmental readiness;
  • attendance;
  • motivation;
  • home support;
  • prior educational experiences;
  • language proficiency;
  • learning differences;
  • medical conditions;
  • emotional regulation;
  • practice outside the Center; and
  • individual learning pace.

The Center is committed to providing high-quality educational services but cannot guarantee identical outcomes among students.

5. ENROLLMENT

Enrollment is subject to available space and the Center’s acceptance of the Student into the Program.

The Parent certifies that all enrollment information provided is complete and accurate.

Parents agree to promptly notify the Center of changes involving:

  • emergency contacts;
  • custody arrangements affecting pickup authority;
  • address;
  • telephone numbers;
  • email addresses;
  • medical conditions;
  • allergies;
  • diagnosed learning differences;
  • behavioral concerns; or
  • other information that may reasonably affect the Student’s participation.

Failure to disclose information reasonably necessary for the safe or effective instruction of a Student may limit the Center’s ability to provide appropriate services.

The Center reserves the right to decline enrollment or discontinue services when it reasonably determines that enrollment is not appropriate for the Student or when continued participation would materially interfere with instruction, safety, or Center operations.

6. TUITION, FEES, PAYMENTS & REFUNDS

Tuition, assessments, registration fees, instructional packages, and other charges are established separately and may be modified prospectively.

Unless otherwise stated in writing:

  • payment is due according to the selected payment plan;
  • returned payments may incur administrative fees;
  • overdue accounts may result in suspension of services;
  • Parent remains responsible for unpaid balances.

Refund Policy

FUNetix strives to provide every Student with a positive educational experience.

Because educational progress varies significantly among students, refunds are governed by this Refund Policy.

If, after reasonable instructional effort, the Center determines that a Student is progressing substantially more slowly than anticipated despite appropriate attendance and participation, the Center may, at its sole discretion:

  • recommend additional instructional time;
  • modify instructional pacing;
  • recommend supplemental services;
  • recommend discontinuation of services; or
  • offer a full or partial refund for unused instructional sessions.

Nothing contained herein guarantees eligibility for any refund.

7. SCHEDULING, ATTENDANCE & STUDENT CONDUCT

Scheduling

Instruction is provided by appointment.

The Center reserves the right to modify schedules because of holidays, instructor illness, emergencies, weather, facility maintenance, or other operational needs.

Attendance

Regular attendance is essential to educational success.

Parents should make every reasonable effort to ensure Students arrive on time and are prepared to participate.

Missed sessions, late arrivals, early departures, cancellations, and make-up sessions shall be governed by the Center’s Scheduling Policy.

Student Conduct

Students are expected to demonstrate respectful behavior toward Staff, volunteers, tutors, and fellow Students.

The following behaviors may result in immediate intervention, removal from class, suspension, or dismissal:

  • physical aggression;
  • threats;
  • bullying;
  • harassment;
  • profanity directed toward others;
  • repeated disruption;
  • destruction of property;
  • refusal to follow reasonable instructions;
  • behavior creating an unsafe environment; or
  • conduct that materially interferes with instruction.

The Center may require immediate Parent pickup whenever Staff determine that continued participation is not appropriate.

Repeated behavioral concerns may result in permanent dismissal from the Program.

Refund eligibility following dismissal shall be determined in accordance with the Center’s Refund Policy.

8. PARENT RESPONSIBILITIES

The Parent plays an essential role in the educational success of every Student.

By enrolling, the Parent agrees to:

  • provide accurate enrollment information;
  • maintain current contact information;
  • disclose known learning differences, diagnoses, or educational accommodations relevant to instruction;
  • disclose medical conditions affecting participation;
  • ensure regular attendance;
  • arrive on time and remain at the Center during instruction;
  • reinforce respectful behavior;
  • encourage consistent home reading when recommended;
  • communicate concerns promptly; and
  • partner with Center Staff in supporting the Student’s educational growth.

Parents acknowledge that educational services are most successful when the Center and family work collaboratively toward shared goals.

Failure to cooperate with reasonable Center policies may result in suspension or termination of services.

9. THE FUNetix® READING PROGRAM

FUNetix Reading Centers utilize proprietary instructional methodologies, curriculum, educational software, assessments, and related instructional materials developed and licensed by the American Youth Literacy Foundation.

Instruction is designed to systematically develop phonemic awareness, decoding skills, reading fluency, comprehension, vocabulary development, and reading confidence through structured, sequential instruction.

Although the curriculum follows an organized instructional progression, individual lesson pacing may vary from student to student.

Center staff may modify instructional pacing, repeat lessons, provide additional practice, introduce supplemental activities, or adjust instructional strategies whenever they believe doing so will better serve the educational needs of the Student.

Enrollment in the Program does not guarantee completion of any predetermined number of lessons within any specified period of time.

10. THE “12-HOUR AND “6 WEEK” READING PROGRAM” STATEMENT

FUNetix has developed a curriculum commonly referred to as the “FUNetix 12-Hour Reading Program.”

The Parent understands and acknowledges that this description refers to the instructional design and curriculum framework of the Program and is not a guarantee that every Student will complete the curriculum within twelve (12) instructional hours, or within 6 weeks at a rate of three, 45-minute sessions per week.

Individual completion times may vary considerably.

Many factors influence instructional pace, including but not limited to:

  • age;
  • developmental readiness;
  • previous educational experiences;
  • attendance;
  • consistency of instruction;
  • home reinforcement;
  • attention span;
  • motivation;
  • English language proficiency;
  • diagnosed or undiagnosed learning differences;
  • medical conditions; and
  • emotional or behavioral factors.

Some Students may progress substantially faster than anticipated, while others may require additional instructional time beyond the curriculum’s estimated instructional duration.

No employee, tutor, volunteer, instructor, Site Lead, or representative of the Center is authorized to guarantee that any particular Student will complete the curriculum within a specific number of hours or sessions.

11. EDUCATIONAL OUTCOMES DISCLAIMER

FUNetix strives to provide high-quality educational services designed to improve literacy skills and reading confidence.

However, education is an individualized process.

The Parent acknowledges that no representation or warranty has been made that the Student will:

  • achieve any particular reading level;
  • achieve a particular grade-level equivalency;
  • complete the curriculum within any specified timeframe;
  • earn improved school grades;
  • qualify for gifted or advanced academic placement;
  • overcome a diagnosed learning disability;
  • eliminate the need for educational accommodations; or
  • achieve any other specific academic outcome.

Educational outcomes vary based upon numerous factors beyond the Center’s control.

The Parent further acknowledges that statements describing typical student progress, success stories, testimonials, demonstrations, or examples presented through the website, social media, advertising, brochures, informational meetings, or other promotional materials describe individual experiences and should not be interpreted as guarantees of universal performance.

12. PROGRESS MONITORING & EARLY INTERVENTION

FUNetix regularly evaluates student progress throughout enrollment.

Progress monitoring may include formal assessments, informal observations, lesson completion, reading fluency, decoding ability, comprehension, instructional engagement, and other educational indicators.

If the Center reasonably determines that a Student is progressing substantially slower than anticipated, the Center will make reasonable efforts to communicate with the Parent regarding the Student’s progress.

Depending upon the circumstances, the Center may recommend one or more of the following:

  • additional instructional time;
  • increased instructional frequency;
  • modified pacing;
  • supplemental educational activities;
  • home practice recommendations;
  • additional assessment;
  • consultation with outside educational professionals;
  • temporary suspension of instruction pending further evaluation;
  • discontinuation of services if the Program is determined not to be an appropriate educational fit.

Whenever practical, FUNetix will attempt to identify significant concerns early so that Parents may make informed educational decisions before unnecessary instructional expenses are incurred.

Nothing in this section guarantees that the Center will identify every educational concern or predict every student’s future performance.

13. LEARNING DIFFERENCES & INDIVIDUALIZED INSTRUCTION

FUNetix welcomes Students with a wide variety of educational backgrounds and learning needs whenever the Center reasonably believes it can provide appropriate instructional services.

Parents acknowledge that certain Students may require substantially more instructional time than others.

Examples include, but are not limited to, Students with:

  • dyslexia;
  • dysgraphia;
  • ADHD;
  • autism spectrum disorder;
  • speech or language disorders;
  • developmental delays;
  • intellectual disabilities;
  • auditory processing disorders;
  • vision impairments;
  • emotional or behavioral challenges;
  • English language learner status; or
  • other diagnosed or undiagnosed learning differences.

Enrollment in the Program should not be interpreted as a representation that FUNetix provides special education services or guarantees outcomes for Students with any particular diagnosis.

The Parent understands that accommodations provided by the Center are educational in nature and may differ from accommodations available within a public-school setting.

14. EDUCATIONAL OBSERVATIONS; NO MEDICAL OR CLINICAL DIAGNOSIS

FUNetix personnel are educators.

They are not acting as physicians, psychologists, psychiatrists, licensed speech-language pathologists, occupational therapists, behavioral health providers, licensed professional counselors, or other licensed healthcare professionals unless specifically identified in writing.

Observations made by Center personnel regarding a Student’s educational performance are intended solely to assist instructional planning.

Any comments, recommendations, or concerns expressed by Center personnel should not be interpreted as medical, psychological, psychiatric, neurological, or educational diagnoses.

Parents are encouraged to consult appropriately licensed professionals whenever developmental, behavioral, medical, or educational evaluations may be warranted.

The Center assumes no responsibility for diagnosing or failing to diagnose any medical, psychological, developmental, or learning condition.

15. HEALTH, WELLNESS & SAFETY

Parents agree to notify the Center of any medical condition, allergy, dietary restriction, physical limitation, behavioral concern, or other health-related information that could reasonably affect the Student’s participation or safety.

Students who exhibit symptoms of contagious illness, including fever, vomiting, diarrhea, or other conditions that may place other Students or Staff at risk, may be required to remain home or be picked up from the Center.

The Center reserves the right to temporarily exclude Students when participation could reasonably jeopardize the health or safety of others.

FUNetix does not administer medications.

Parents remain responsible for ensuring that emergency contact information remains current throughout enrollment.

16. EMERGENCY MEDICAL PROCEDURES

The Parent authorizes the Center to take reasonable action to protect the health and safety of the Student during participation in Center activities.

If Center personnel reasonably believe that emergency medical treatment is necessary, the Parent authorizes the Center to:

  • contact emergency medical services;
  • contact the Parent or emergency contacts;
  • provide first aid within the scope of staff training;
  • arrange transportation for emergency care when appropriate; and
  • share relevant medical information with emergency responders.

According to Center policy, Parents are required to remain at the Center or in the parking lot during instruction. However, in the unlikely event that the Parent is absent, the Parent understands that reasonable efforts will be made to notify the Parent before medical treatment whenever circumstances permit.

The Parent remains financially responsible for all medical expenses incurred as a result of emergency treatment.

The Center does not assume responsibility for the quality, availability, or outcome of medical services provided by third-party healthcare providers or emergency responders.

17. ASSUMPTION OF RISK

The Parent understands that participation in educational programs, tutoring sessions, assessments, classroom activities, and related Center functions involves ordinary risks that cannot be completely eliminated.

Such risks may include, but are not limited to:

  • slips, trips, and falls;
  • accidental contact between students;
  • minor play area or classroom injuries;
  • illness or exposure to contagious diseases;
  • emotional frustration associated with learning challenges;
  • technology interruptions;
  • weather-related interruptions;
  • evacuation during emergencies; and
  • other risks reasonably associated with participation in educational activities.

The Parent voluntarily accepts and assumes these ordinary risks on behalf of the Student.

Nothing contained herein shall be interpreted as releasing the Center from liability for conduct that cannot legally be waived under applicable law, including gross negligence, willful misconduct, or intentional wrongdoing.

18. RELEASE OF LIABILITY

To the fullest extent permitted by Pennsylvania law, the Parent, individually and on behalf of the Student, releases and forever discharges the American Youth Literacy Foundation, FUNetix Reading Centers, their officers, directors, employees, tutors, learning coaches, volunteers, contractors, interns, Site Leads, affiliates, successors, and assigns from claims arising out of or relating to participation in Center activities, except where prohibited by law.

This release includes, without limitation, claims relating to:

  • ordinary negligence;
  • accidental injuries;
  • instructional decisions;
  • educational recommendations;
  • classroom management decisions;
  • scheduling changes;
  • technology failures;
  • website interruptions;
  • property damage;
  • lost or misplaced personal belongings;
  • weather-related closures;
  • acts or omissions of third-party vendors; and
  • other claims arising from ordinary operation of the Center.

The Parent acknowledges that this Release does not apply where liability cannot legally be waived.

19. LIMITATION OF LIABILITY

To the fullest extent permitted by law, the total liability of FUNetix, regardless of the legal theory asserted, shall not exceed the amount of tuition actually paid for the educational services giving rise to the claim.

Under no circumstances shall the Center be liable for:

  • consequential damages;
  • incidental damages;
  • special damages;
  • punitive damages;
  • loss of educational opportunity;
  • emotional distress unrelated to physical injury;
  • lost wages;
  • travel expenses;
  • loss of future earnings;
  • indirect business losses;
  • attorney’s fees except where required by law; or
  • any damages that could not reasonably have been anticipated.

The Parent acknowledges that tuition reflects this agreed allocation of risk.

20. INDEMNIFICATION

The Parent agrees to defend, indemnify, and hold harmless the American Youth Literacy Foundation, FUNetix Reading Centers, and their officers, directors, employees, volunteers, contractors, affiliates, successors, and assigns from claims, liabilities, damages, costs, expenses, and reasonable attorneys’ fees arising from:

  • inaccurate information supplied by the Parent;
  • violation of this Agreement;
  • intentional misconduct of the Parent or Student;
  • damage caused by the Student beyond ordinary wear and tear;
  • unauthorized use of Center materials; or
  • claims brought by third parties arising from the Parent’s or Student’s actions.

This provision survives termination of enrollment.

21. INTELLECTUAL PROPERTY

All FUNetix instructional materials are proprietary.

This includes, but is not limited to:

  • curriculum;
  • lesson plans;
  • software;
  • mobile applications;
  • assessments;
  • instructional methods;
  • graphics;
  • illustrations;
  • videos;
  • worksheets;
  • teacher guides;
  • trademarks;
  • service marks;
  • logos;
  • trade dress;
  • marketing materials; and
  • all associated copyrights, patents, trade secrets, and other intellectual property rights.

Enrollment grants the Parent and Student a limited, non-transferable license to use these materials solely for participation in the enrolled educational program.

Parents may not:

  • copy instructional materials;
  • photograph proprietary curriculum for redistribution;
  • record lessons without permission;
  • reproduce assessments;
  • upload materials to the Internet;
  • share student logins;
  • reverse engineer software;
  • train artificial intelligence systems using FUNetix content;
  • commercially exploit Center materials; or
  • otherwise use proprietary materials beyond the limited educational license granted herein.

All rights not expressly granted remain reserved by the American Youth Literacy Foundation.

22. WEBSITE USE

Users agree to use the Center’s website only for lawful purposes.

Users shall not:

  • attempt unauthorized access;
  • interfere with website operation;
  • upload malicious software;
  • scrape website content;
  • harvest user information;
  • impersonate another individual;
  • transmit unlawful or offensive material;
  • interfere with website security; or
  • engage in activities that could impair website performance.

The Center reserves the right to suspend website access for misuse.

23. PRIVACY

The Center respects the privacy of Students and Parents.

Collection, storage, use, disclosure, and retention of personal information shall be governed by the Center’s Privacy Policy, which is outlined below..

Parents acknowledge that educational records, attendance records, assessment information, payment information, and communications may be maintained electronically.

Reasonable administrative, technical, and physical safeguards are employed to protect confidential information; however, no electronic storage system or Internet transmission can be guaranteed to be completely secure.

Depending on the services you use, we may collect information such as:

Parent or Guardian Information

  • Name
  • Address
  • Telephone number
  • Email address
  • Emergency contact information
  • Billing information
  • Payment history
  • Communication preferences

Student Information

  • Name
  • Date of birth
  • Grade level
  • School
  • Reading assessment results
  • Attendance records
  • Instructional progress
  • Tutor observations
  • Learning goals
  • Educational accommodations voluntarily provided by the parent

Health and Safety Information

Parents may voluntarily provide information that helps us safely serve a student, including:

  • allergies;
  • emergency medical information;
  • medications relevant to participation;
  • mobility concerns;
  • behavioral or sensory considerations; and
  • other information reasonably necessary for student safety.

We request only the information reasonably necessary to provide our educational services safely and effectively.

FUNetix does not intentionally collect information unrelated to providing educational services.

Except where legally required or voluntarily provided by a parent, we generally do not request:

  • Social Security numbers;
  • financial account passwords;
  • biometric identifiers;
  • unrelated medical records; or
  • sensitive personal information not needed for enrollment or instruction.

We use information to:

  • enroll students;
  • schedule appointments;
  • provide reading instruction;
  • monitor educational progress;
  • communicate with families;
  • maintain attendance records;
  • process payments;
  • improve educational programs;
  • maintain student safety;
  • respond to emergencies;
  • comply with applicable laws; and
  • operate the Center effectively.

We use information only for legitimate educational and operational purposes.

Protecting children’s privacy is one of our highest priorities.

We collect information about students only as reasonably necessary to provide educational services.

Parents or legal guardians control enrollment decisions and generally serve as the primary point of contact regarding their child’s information.

During enrollment we may maintain educational records including:

  • reading assessments;
  • lesson completion;
  • attendance;
  • instructional notes;
  • tutoring recommendations;
  • progress reports;
  • conference notes; and
  • communications related to instruction.

These records help us provide individualized educational services and monitor student progress over time.

FUNetix does not sell or rent student or parent personal information.

We may share information only when reasonably necessary, including with:

  • payment processors;
  • scheduling software providers;
  • secure technology vendors;
  • educational software providers supporting our instructional services;
  • emergency responders when necessary to protect health or safety;
  • governmental agencies when required by law; or
  • other parties with the parent’s authorization.

We require service providers to use information only for the services they perform on our behalf, subject to their contractual obligations.

Photographs and video recordings taken solely for security, documentation, classroom operations, or educational purposes may be maintained as part of normal Center operations.

A student’s identifiable image, name, testimonial, or likeness will not be used for marketing, advertising, fundraising, public relations, social media, or promotional materials without the parent’s separate written authorization through the FUNetix Media Release.

Parents may decline marketing use of their child’s image without affecting enrollment.

When you visit our website, certain information may be collected automatically, including:

  • browser type;
  • device type;
  • operating system;
  • pages visited;
  • referring website;
  • approximate geographic location;
  • IP address;
  • date and time of visits; and
  • similar technical information.

This information helps us improve website performance, security, and user experience.

Our website may use cookies and similar technologies to:

  • remember user preferences;
  • improve website functionality;
  • understand website usage;
  • measure performance; and
  • improve our online services.

You may disable cookies through your browser settings, although some website features may function differently.

FUNetix uses reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction.

While we work diligently to protect information, no method of Internet transmission or electronic storage can be guaranteed to be completely secure.

Accordingly, we cannot guarantee absolute security.

We retain information only as long as reasonably necessary to:

  • provide educational services;
  • comply with legal obligations;
  • resolve disputes;
  • maintain business records;
  • protect the rights of students, families, and the Center; or
  • enforce our agreements.

When information is no longer required, we seek to dispose of it using reasonable and appropriate methods.

Parents may generally request to:

  • review their enrollment information;
  • update contact information;
  • correct inaccuracies;
  • update emergency contacts;
  • update communication preferences;
  • request copies of certain records, subject to applicable law; and
  • ask questions regarding this Privacy Policy.

Some records may be retained despite deletion requests where required by law or necessary to protect legitimate business or legal interests.

FUNetix may use reputable third-party providers for payment processing, scheduling, educational software, website hosting, cloud storage, email delivery, and related operational services.

These providers maintain their own privacy practices. We encourage families to review the privacy policies of any third-party services they use directly.

We may update this Privacy Policy from time to time.

Material changes will be communicated through reasonable means, such as our website, email, or enrollment portal.

The current version will always be available through the Center.

24. COMMUNICATIONS

The Parent authorizes the Center to communicate regarding enrollment and educational services through reasonable communication methods, including:

  • telephone;
  • email;
  • text messaging;
  • online parent portals;
  • scheduling software;
  • printed notices; and
  • other communication platforms used by the Center.

Operational communications may include:

  • appointment reminders;
  • emergency notifications;
  • progress updates;
  • billing notices;
  • scheduling changes;
  • policy updates; and
  • other information reasonably related to enrollment.

Marketing communications will be governed by the Parent’s separately selected communication preferences and applicable law.

Parents may update communication preferences at any time, although certain operational communications necessary to administer enrollment may continue.

25. ELECTRONIC RECORDS & SIGNATURES

The Parent consents to the use of electronic records, electronic disclosures, electronic acknowledgments, and electronic signatures in connection with enrollment and Center operations.

Checking an electronic acceptance box, typing a name into an electronic signature field, signing on an electronic device, or otherwise electronically indicating agreement shall constitute the Parent’s legally binding signature to the fullest extent permitted under applicable federal and Pennsylvania law.

Electronic copies of this Agreement shall be deemed originals.

The Parent agrees that electronically stored records maintained by the Center may be introduced as evidence in any legal proceeding to the same extent as paper records.

The Parent is responsible for maintaining copies of enrollment documents made available electronically by the Center.

26. PHOTOGRAPHY, VIDEO & MEDIA

The Parent acknowledges that the Center may occasionally photograph or record general classroom activities for educational, documentation, security, or operational purposes.

FUNetix will not intentionally use a Student’s identifiable image, video, name, testimonial, or likeness for advertising, marketing, fundraising, social media, public relations, promotional materials, television, print publications, websites, or similar public communications without the Parent’s separate written Media Release authorization.

The Parent understands that participation in Center activities may result in incidental appearance in group photographs or videos in circumstances permitted by law or where individual identification is not the primary purpose of the image.

The Parent’s decision regarding the separate Media Release will not affect the Student’s eligibility to participate in instructional services.

27. CHANGES TO POLICIES

The Center may modify operational policies, schedules, pricing, instructional procedures, curriculum, technology platforms, and administrative procedures as reasonably necessary to improve services or comply with applicable law.

Material changes to this Agreement affecting the legal rights or obligations of enrolled families will become effective only after reasonable notice has been provided.

Continued participation following such notice constitutes acceptance of those changes unless prohibited by law.

28. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction located within the Commonwealth of Pennsylvania unless otherwise required by applicable law.

29. SEVERABILITY

If any provision of this Agreement is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Any unenforceable provision shall be interpreted as closely as possible to reflect the original intent while remaining legally enforceable.

30. ENTIRE AGREEMENT

This Agreement, together with the Center’s Privacy Policy, Refund Policy, Emergency Medical Authorization, Communication Consent, and any separately executed Media Release or other enrollment documents, constitutes the complete agreement between the Parent and FUNetix Reading Centers concerning the Student’s enrollment.

No oral statements, marketing materials, promotional presentations, website content, or informal discussions shall modify this Agreement unless expressly incorporated in writing by the Center.

No employee, tutor, volunteer, Site Lead, contractor, or representative is authorized to alter or waive any provision of this Agreement except through written authorization approved by Center management.

31. NO WAIVER

The Center’s failure to enforce any provision of this Agreement on one occasion shall not constitute a waiver of its right to enforce that provision or any other provision in the future.

32. FORCE MAJEURE

The Center shall not be responsible for delays, interruptions, cancellations, or inability to provide services resulting from circumstances beyond its reasonable control.

Such circumstances include, but are not limited to:

  • severe weather;
  • fire;
  • flood;
  • power outages;
  • internet outages;
  • public health emergencies;
  • government orders;
  • labor disruptions;
  • acts of terrorism;
  • civil disturbances;
  • natural disasters; or
  • other unforeseen events beyond the reasonable control of the Center.

Whenever reasonably practical, the Center may reschedule services or provide alternative instructional arrangements.
